When entering into a second, or subsequent, marriage, Patterson Law Firm advises you to obtain a prenuptial or postnuptial agreement. A pre-marital agreement protects the personal and financial interests of each client by designating certain property as owned specifically by one spouse and not the other. If one spouse has significant debt, a prenuptial agreement can free the other spouse from acquiring that debt. Spouses also have the option to commingle all their property in the future, if they find there are personal, financial or tax benefits in doing so.
Those with children from previous relationships have more to consider when marrying a second time. Child custody and/or parenting plan schedules may need to be modified to accommodate the new living arrangements. Child support modifications may be necessary.
